This website is operated by Carnivore Cartel Ltd, trading as LotaSquad. Throughout these Terms, the words “LotaSquad”, “we”, “us” and “our” refer to Carnivore Cartel Ltd.
LotaSquad operates this website and online store, including its information, content, features, products and related services (collectively, the “Services”). Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you.
These Terms of Service (“Terms”) explain the conditions that apply when you browse our website, use our Services or place an order with us. Please read them carefully before using the website.
By accessing or using our Services, you agree to these Terms and the policies referred to within them, including our Privacy Policy and Returns & Refund Policy. If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms limits or excludes any rights you have under applicable consumer law.
1. Eligibility and accounts
You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order through our website.
When using our Services or placing an order, you agree to provide accurate, current and complete information, including your name, email address, billing details and delivery address.
If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account. You must notify us promptly if you believe your account has been accessed without permission.
We may suspend or close an account where we reasonably believe it has been used unlawfully, fraudulently or in breach of these Terms.
2. Product information
We take reasonable care to ensure that product descriptions, photographs, specifications, prices and other information displayed on our website are accurate.
Images are provided for illustrative purposes. Colours and appearance may vary slightly depending on lighting, manufacturing tolerances and the screen or device used to view the website. Product packaging may also differ slightly from the packaging shown.
Minor differences that do not materially affect the product’s description, quality, performance or intended use will not make the product defective.
We may improve or modify product specifications from time to time, provided that any change does not materially reduce the product’s quality or functionality.
All products are subject to availability. We may discontinue a product or limit the quantity available for purchase at any time.
Nothing in this section affects your statutory rights where a product is faulty, not as described, not fit for purpose or not of satisfactory quality.
3. Using the LotaSquad WC47
The LotaSquad WC47 is a portable personal-hygiene product. It is not a medical device and is not intended to diagnose, treat, cure or prevent any medical condition.
You must use, clean, charge, store and maintain the product in accordance with the instructions supplied with it. Only use the product for its intended purpose and with suitable clean water.
You must not:

Use the product in a way that is contrary to the supplied instructions;

Immerse electrical components in water unless the instructions expressly state that this is permitted;

Use a damaged charging cable, connector, pump or other electrical component;
-
Modify, dismantle or attempt an unauthorised repair of the product;
-
Use unsuitable liquids, chemicals or substances in the water tank; or
-
Allow children to operate the product without appropriate adult supervision.
If you have a medical condition, have recently undergone surgery, experience pain or irritation, or are uncertain whether the product is suitable for you, you should seek advice from an appropriate healthcare professional before use.
Failure to follow the supplied instructions may damage the product and could affect your entitlement to a remedy where the problem has been caused by misuse rather than an inherent fault.
4. Orders and formation of contract
When you place an order, you are making an offer to purchase the products shown in your basket.
After placing an order, you should receive an order acknowledgement. This confirms that we have received your order but does not necessarily mean that we have accepted it.
A binding contract is formed when we send you confirmation that your order has been accepted or dispatched. Each product dispatched may constitute a separate contract of sale.
We may decline or cancel an order before dispatch for reasons including:

The product is unavailable;

Payment could not be authorised;

Your billing or delivery information could not be verified;

We identified an error in the price or product description;
-
We reasonably suspect fraud, misuse or unauthorised resale;

The order breaches a stated quantity restriction; or
-
We cannot lawfully deliver the product to the requested destination.
If payment has already been taken for an order we cannot accept, we will refund the amount paid.
Please review your order and delivery details carefully before submitting it. Contact us promptly if you identify an error. We cannot guarantee that an order can be amended or cancelled once it has entered the fulfilment process.
5. Prices and payment
Prices are shown in pounds sterling unless stated otherwise.
The price payable is the price displayed at checkout when the order is placed. Delivery charges and any other applicable charges will be shown before you confirm the order.
Prices include UK VAT where VAT is applicable. Customers ordering for delivery outside the United Kingdom may be responsible for import VAT, customs duties, clearance fees or other local charges unless checkout expressly states that these are included.
We may change prices at any time, but changes will not affect orders that we have already accepted.
If a price is clearly incorrect because of an obvious administrative or technical error, we are not required to supply the product at that incorrect price. We will contact you and give you the option to purchase at the correct price or cancel the order for a full refund.
Discount codes and promotions:

Must be used in accordance with their stated conditions;

Cannot normally be exchanged for cash;

Cannot be applied retrospectively;
-
May be limited to one use per customer or order; and
-
May be withdrawn or amended where reasonably necessary.
You confirm that you are authorised to use the payment method submitted with your order. Payment is processed through our authorised third-party payment providers, and their own terms may also apply.
6. Delivery
Available delivery methods, charges and estimated timescales will be displayed at checkout.
Delivery dates and times are estimates unless we expressly agree otherwise. We will take reasonable steps to deliver within the stated timescale and, in any event, within the period required by applicable law.
We are responsible for the goods until they are delivered to you, or to a person you have identified to receive them. If you instruct the courier to leave the parcel in a nominated safe place or with a particular neighbour, delivery to that location or person may be treated as delivery to you.
You are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because you supplied incorrect or incomplete information, you may be responsible for reasonable redelivery or return costs.
If your parcel is delayed, lost or appears to have been misdelivered, contact us at hello@lotasquad.com so that we can investigate with the carrier.
If delivery is materially delayed for reasons within our control, you may have the right to cancel the order in accordance with applicable consumer law.
7. Cancellations, returns and refunds
Returns, cancellations, exchanges and refunds are governed by our Returns & Refund Policy, which forms part of these Terms.
The LotaSquad WC47 is a sealed personal-hygiene product. For health and hygiene reasons, a change-of-mind return cannot be accepted once its hygiene seal has been broken after delivery.
This hygiene restriction does not affect your statutory rights if the product is faulty, damaged, not as described or otherwise does not conform to the contract.
Please read our Returns & Refund Policy before breaking the hygiene seal.
8. Faulty products and statutory rights
We are under a legal duty to supply products that conform to the contract. Products must be as described, fit for their intended purpose and of satisfactory quality.
If you believe that your product is faulty, contact hello@lotasquad.com with your order number and details of the problem. We may request photographs, video evidence or reasonable troubleshooting information to help assess the issue.
Depending on the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, a price reduction or refund.
We are not responsible for faults or damage caused by:

Accidental or deliberate damage;

Misuse or neglect;
-
Failure to follow the supplied instructions;

Unsuitable liquids, cleaning products or charging equipment;
-
Unauthorised modifications or repairs;
-
Normal wear and tear; or
-
Damage occurring after risk has lawfully passed to you.
Nothing in these Terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer-protection legislation.
9. Personal use and resale
Products purchased through our consumer website are intended primarily for personal or household use.
You must not purchase products for unauthorised commercial resale, export or distribution. Trade customers should contact us before ordering.
We may limit quantities or cancel an order where we reasonably believe products are being purchased for unauthorised resale, fraudulent activity or misuse.
10. Intellectual property
The website and its contents—including the LotaSquad name, branding, logos, product names, designs, text, graphics, photographs, videos, audio, downloads and website layout—are owned by or licensed to us and are protected by intellectual-property laws.
You may access and use the website for lawful personal and non-commercial purposes.
Unless we have given prior written permission, you must not:

Copy, reproduce, republish or distribute our website content;

Modify or create derivative works from our content;

Use our branding, product imagery or marketing materials commercially;

Remove copyright, trademark or ownership notices;

Frame or mirror any material from our website;

Suggest that you or your business are connected with, endorsed by or authorised by LotaSquad.
Nothing in these Terms transfers any intellectual-property rights to you.
11. Customer reviews and other submitted content
If you submit a review, photograph, video, comment, suggestion or other content to us (“Submitted Content”), you confirm that:

You created it or have permission to submit it;

It is accurate and is based on your genuine experience where presented as a review;

It does not infringe another person’s intellectual-property, privacy or other rights;

It is not defamatory, unlawful, threatening, obscene or misleading; and
-
It does not contain malware, spam or undisclosed advertising.
You grant us a non-exclusive, worldwide, royalty-free licence to reproduce, display, edit for length or formatting, distribute and use Submitted Content in connection with operating and promoting LotaSquad and our products.
You retain ownership of your original content. We will not materially misrepresent the meaning of a genuine customer review.
We may decline to publish or may remove content that breaches these Terms, is unrelated to the product, contains personal information or is otherwise unlawful. We will not suppress a genuine review merely because it is negative.
12. Third-party services and links
Our website may include links to third-party websites, payment services, social-media platforms or other external services.
Third-party websites and services are controlled by their respective operators. We are not responsible for their content, availability, security or privacy practices.
If you visit or purchase from a third party, its terms and policies will apply. A link from our website does not necessarily mean that we endorse the third party.
13. Shopify
Our store is hosted by Shopify, which provides the ecommerce technology used to operate the website.
Any purchase made from our store is made directly between you and Carnivore Cartel Ltd, trading as LotaSquad. Shopify is not the seller of the LotaSquad products you purchase from us.
Shopify may process certain personal information to provide and improve its services. Further information is available in our Privacy Policy and in Shopify’s Privacy Policy.
Nothing in this section affects any rights or claims you may have against us as the seller.
14. Privacy and cookies
Our collection and use of personal information are explained in our Privacy Policy.
Our use of cookies and similar technologies is explained in our Cookie Policy and through the cookie controls available on the website.
By using the website, you acknowledge that your information may be processed by Shopify, payment providers, delivery companies and other service providers where necessary to operate the store, fulfil orders, prevent fraud and provide the Services.
15. Acceptable use
You may use our website only for lawful purposes.
You must not:

Use the website fraudulently or unlawfully;

Attempt to gain unauthorised access to the website, customer accounts, servers or connected systems;

We may temporarily suspend, withdraw or restrict parts of the website for maintenance, security, operational or legal reasons.
Occasionally, information may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, availability, delivery charges or transit times. We may correct these errors and update the information.
If an error materially affects an order you have placed, we will contact you and offer an appropriate solution, which may include reconfirming or cancelling the order and issuing a refund.
17. Our responsibility to you
We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We do not exclude or limit liability where doing so would be unlawful. This includes liability for:

Death or personal injury caused by our negligence;

Fraud or fraudulent misrepresentation;

Breach of your statutory rights relating to products;

Defective products where liability cannot legally be excluded; or

Any other liability that cannot be excluded or limited by law.
We are not responsible for losses that were not foreseeable when the contract was formed.
If you are purchasing as a consumer, we are not responsible for business losses, including loss of profit, revenue, opportunity, goodwill or business interruption, arising from personal or household use of the product.
Nothing in these Terms affects your statutory consumer rights.
18. Events outside our control
We will not be responsible for delay or failure caused by events outside our reasonable control, such as severe weather, transport disruption, industrial action, natural disasters, utility or telecommunications failure, governmental action or widespread carrier disruption.
If such an event affects your order, we will contact you where reasonably possible and take steps to minimise the delay. Your statutory rights, including any right to cancel following a substantial delay, remain unaffected.
19. Suspension and termination
You may stop using our Services at any time.
We may suspend or terminate your access to an account or parts of the Services where we reasonably believe that you:

Have materially breached these Terms;

Have engaged in fraud or unlawful activity;

Pose a security risk; or

Have used the Services in a way that may harm us, Shopify, other customers or third parties.
Termination does not affect rights, obligations or liabilities that arose before termination. Provisions which by their nature are intended to continue will remain effective.
20. Transfer of rights
You may not transfer your rights or obligations under these Terms without our written agreement, except where the law permits you to do so.
We may transfer our rights and obligations to another organisation, for example as part of a sale or restructuring of the business. We will ensure that any transfer does not reduce your contractual or statutory rights and will notify you where required.
21. Severability
If a court or other competent authority finds that part of these Terms is unlawful or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary.
The remaining provisions will continue in effect.
22. No waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
A waiver relating to one breach will not automatically apply to any later breach.
23. Third-party rights
Unless expressly stated otherwise, these Terms do not give any third party the right to enforce them under the Contract (Third Party Rights) (Scotland) Act 2017 or any equivalent legislation.
24. Governing law and disputes
These Terms and any contract between you and us are governed by the laws of Scotland.
If you are a consumer living elsewhere in the United Kingdom, you will retain the benefit of any mandatory protections provided by the law of the part of the United Kingdom in which you live.
Any dispute may be brought before the Scottish courts. If you live in England, Wales or Northern Ireland, you may also be entitled to bring proceedings in the courts where you live.
We encourage you to contact us first so that we can try to resolve any complaint informally.
25. Changes to these Terms
We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.
The latest version will be published on this page with an updated revision date. Changes will not retrospectively alter an order that we have already accepted unless required by law or agreed with you.
